DECISION & ORDER ON MOTION

Allen B. Davidson, Also Known as Beau Davidson, Appellant, v James H. White, III, Doing Business as New Century Festivals, Respondent.

Motion by appellant for an extension of time to perfect an appeal from a judgment of the Justice Court of the Town of Deer Park, Orange County, entered July 22, 2024, and, in effect, to enlarge the record on appeal to include various exhibits not in the record before the Appellate Term.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the branch of the motion seeking an extension of time to perfect the appeal is granted, and the appeal shall be perfected on or before July 25, 2025; and it is further,

ORDERED that in the event the appeal is not perfected by July 25, 2025, the court, on its own motion, may dismiss the appeal, or respondent may move, on three days' notice, to dismiss the appeal, and if the appellant is unrepresented, may serve such motion upon the appellant in person; and it is further,

ORDERED that the branch of the motion in effect, to enlarge the record on appeal to include various exhibits not in the record before the Appellate Term is denied with leave to move for such relief in the trial court.
