Appeal from an order of the Supreme Court, Suffolk County, dated March 9, 2023. Motion by the respondents to enlarge the record or, in the alternative, for leave to serve and file a supplemental record containing certain material. Separate motion by the respondents to extend the time to serve and file a brief.
Upon the papers filed in support of the motion, inter alia, to enlarge the record and the papers filed in opposition thereto, and upon the papers filed in support of the motion to extend the time to serve and file a brief and the papers filed in relation thereto, it is
ORDERED that the motion to enlarge the record, or in the alternative, for leave to serve and file a supplemental record is granted to the extent that on or before July 7, 2025, the appellant shall serve and file a supplemental record containing the Supreme Court NYSCEF Document Nos. 14, 16, 79, 73, 78, 82, 84, 85, and 87 filed under Index No. 621830/2021 and NYSCEF Document Nos. 39, 41, 50, 84-87, 95, and 98 filed under Index No. 604939/2022, via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the supplemental record and upload a digital copy of the supplemental record, with proof of service thereof, through the digital portal on this Court's website, and the motion is otherwise denied; and it is further,
ORDERED that the motion to extend the time to serve and file a brief is granted, and on or before July 7, 2025, the respondents shall serve and file the respondents' brief via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the brief and upload a digital copy of the brief, with proof of service thereof, through the digital portal on this Court's website.
