Counsel for respondent-appellant having moved to vacate the dismissal of the appeal taken herein from an order of the Family Court, Onondaga County, entered May 28, 2024, and to be relieved of assignment,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks to vacate the dismissal of the appeal is granted on the condition that the appeal is perfected on or before August 1, 2025, and

It is further ORDERED that the motion insofar as it seeks relief from assignment is granted, and

It is further ORDERED that Martha Hertzberg, Esq., 300 South State Street, Syracuse, New York 13202, is hereby assigned as counsel to conduct the appeal, and

It is further ORDERED that the Onondaga County Family Court Clerk provide Martha Hertzberg, Esq. with copies of all papers and transcripts of stenographic or audiotaped minutes, if any, of the proceedings upon which the appeal is based.
