Company, appellant.

(Index No. 630/2020)

DECISION & ORDER ON MOTION

Appeals from an order of the Supreme Court, Kings County, dated November 10, 2021, and a judgment of the same court dated November 15, 2023. By order to show cause dated March 14, 2025, the parties were directed to show cause before this Court why an order should or should not be made and entered striking the respondent's brief for failure to comply with a decision and order on motion of this Court dated December 23, 2024, in which the parties were directed to serve and file replacement briefs which contain Appellate Division Docket No. 2024-01754, in addition to Appellate Division Docket No. 2021-09464 on the covers.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion to strike the respondent's brief is denied, and on or before July 14, 2025, the respondent shall serve and file a replacement brief which contains Appellate Division Docket No. 2024-01754, in addition to Appellate Division Docket No. 2021-09464 on the cover via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the replacement brief and upload a digital copy of the replacement brief, with proof of service thereof, through the digital portal on this Court's website.
