| DECISION & ORDER ON MOTION |
Appeal from an order of the Supreme Court, Queens County, dated July 1, 2024. Motion by the respondent Sauitre Narine, in effect, to dismiss the appeal upon the death of the respondent Budram Narine on December 23, 2024, or, in the alternative, to stay the appeal due to the death of the respondent Budram Narine.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to stay the appeal is denied as unnecessary (see CPLR 1015); and it is further,
ORDERED that the motion is otherwise denied.
