DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Queens County, dated June 30, 2023. By decision and order on motion of this Court dated March 7, 2025, the appellant was directed to serve and file a supplemental record containing certain material on or before April 7, 2025. Motion by the respondents to dismiss the appeal on the ground that the appellant failed to comply with the decision and order on motion of this Court dated March 7, 2025. Separate motion by the respondents to extend the time to serve and file a brief.

Upon the papers filed in support of the motions and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion to dismiss the appeal is granted, the appeal is dismissed, without costs or disbursements, for failing to comply with the decision and order on motion of this Court dated March 7, 2025; and it is further,

ORDERED the motion by the respondents to extend the time to serve and file a brief is denied as academic.
