| DECISION & ORDER ON MOTION |
Appeals from an order of the Supreme Court, Suffolk County, dated August 16, 2023, and a judgment of the same court dated March 22, 2025. Motion by the respondent to dismiss the appeal from the order on the ground that the right of direct appeal from the order terminated upon entry of the judgment. Cross-motion by the appellant to consolidate the appeals, and to stay enforcement of the judgment, pending hearing and determination of the appeals.
Upon the papers filed in support of the motion and cross-motion and the papers filed in opposition thereto, it is
ORDERED that the motion to dismiss the appeal from the order is held in abeyance and referred to the panel of Justices hearing the appeals for determination upon the argument or submission thereof; and it is further,
ORDERED that the branch of the cross-motion which is to consolidate the appeals is granted, the appeals are consolidated, the record and briefs filed in connection with the appeal from the order are deemed also to be filed in connection with the appeal the judgment, and on or before July 30, 2025, the parties shall serve and file, via NYSCEF, replacement briefs which contain Appellate Division Docket No. 2025-06020 in addition to Appellate Division Docket No. 2023-10069 on the covers, and the appellant shall serve and file, via NYSCEF, a replacement record which contains the judgment and the notice of appeal from the judgment and Appellate Division Docket No. 2025-06020 in addition to Appellate Division Docket No. 2023-10069 on the cover; and it is further,
ORDERED that the branch of the cross-motion which is to stay enforcement of the judgment is denied.
