DECISION & ORDER ON MOTION

Appeals from an order of the Supreme Court, Nassau County, dated May 3, 2023, and a judgment of the same court dated March 21, 2024. By order to show cause dated March 14, 2025, the parties were directed to show cause before this Court why an order should or should not be made and entered striking the respondent's brief for failure to comply with the decision and order on motion of this Court dated November 6, 2024. Motion by the respondent to extend the time to serve and file a replacement brief.

Now, upon the order to show cause and the papers filed in response thereto, and upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion to strike the respondent's brief is denied; and it is further,

ORDERED that the motion to extend the time to serve and file a replacement brief is denied as unnecessary as the replacement brief has been accepted for filing by this Court.
