| DECISION & ORDER ON MOTION |
Appeal from an order of the Family Court, Kings County, dated June 12, 2023, which was dismissed by decision and order on motion of this Court dated July 14, 2023, on the ground that no appeal lies as of right from a nondispositional order in proceedings pursuant to Family Court Act article 6, part 3 (see Family Ct Act § 1112), and no appeal lies as of right from a nondispositional order in proceedings pursuant to Family Court Act article 8 (see Family Ct Act § 1112), and leave to appeal had not been granted. Motion by the appellant for leave to appeal to this Court from the order. Motion by the attorney for the child, inter alia, in effect, to set a visitation schedule for the appellant and the subject child, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion by the appellant and the papers filed in opposition and in relation thereto, and upon the papers filed in support of the motion by the attorney for the child and the papers filed in opposition thereto, it is
ORDERED that the motion by the appellant is denied; and it is further,
ORDERED that the motion by the attorney for the child is denied as academic.
