| DECISION & ORDER ON MOTION |
Proceeding pursuant to CPLR article 78 in the nature of mandamus, which was determined by decision and order of this Court dated November 2, 2022. Motion by the petitioner for leave to reargue the proceeding, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court, and for waiver of costs, fees, and expenses.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to reargue the proceeding, or, in the alternative, for leave to appeal to the Court of Appeals, is denied; and it is further,
ORDERED that the branch of the motion which is for waiver of costs, fees, and expenses is granted to the extent that the motion filing fee is waived, and this branch of the motion is otherwise denied as academic.
