| DECISION & ORDER ON MOTION |
Appeal from an order of the Supreme Court, Kings County, dated December 19, 2024. By decision and order on motion of this Court dated April 16, 2025, the motion by the appellant pursuant to CPL 460.30 for an extension of time to make an application pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this Court from the order was granted and the time for the appellant to make an application pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this Court from the order was extended until May 15, 2025. The appellant has not made an application pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this Court from the order. Motion by the appellant pro se for waiver of costs, fees, and expenses, and for the assignment of counsel.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the Court's own motion, the appeal purportedly taken as of right is dismissed (see CPL 450.10, 450.15); and it is further,
ORDERED that the motion is denied as academic.
