It is Ordered that the motion of the respondent-appellant seeking an order staying the enforcement of the final judgment and warrant of eviction pending the determination of the appeal is granted on the conditions that the respondent-appellant: (1) perfects their appeal on or before the December 2025 term, the filing deadline for which is October 9, 2025. Respondent's briefs are to be filed on or before October 31, 2025; reply briefs, if any, are due on November 7, 2025; (2) pay ongoing use and occupancy, as of July 2025, in the amount of $3,000.00, the amount reserved in the most recent lease agreement. Said monies are to be deposited with the Clerk of the Civil Court on or before July 31, 2025; and (3) continue to deposit ongoing use and occupancy, in the specified amount, with the Clerk of the Civil Court, on or before the tenth (10th) of each subsequent month.
In the event the respondent-appellant fails to comply with the foregoing conditions, the petitioner may move on five days notice for an order vacating the stay.
