DECISION & ORDER ON MOTION

Motion by appellants on an appeal from a judgment of the Civil Court of the City of New York, Kings County, entered October 31, 2023 for, in effect, summary reversal. Separate motion by appellants for an extension of time to perfect the appeal, or, in effect, for summary reversal on the ground that the clerk's return has not been transmitted to this court. Appellants filed a notice of settlement of transcript with the Civil Court on September 9, 2024.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the first motion and the branch of the second motion seeking summary reversal are denied; and it is further,
ORDERED, on the court's own motion, that the Civil Court is directed to settled the transcript and file the return with this Court forthwith; and it is further,
ORDERED that the branch of the second motion seeking an extension of time to perfect the appeal is granted, and the appeal shall be perfected on or before October 15, 2025; and it is further,
ORDERED that in the event the appeal is not perfected by October 15, 2025, the court, on its own motion, may dismiss the appeal, or respondent may move, on three days notice, to dismiss the appeal and may, if appellant is unrepresented, serve such motion upon appellant in person.
