2022-07828 The People, etc., respondent, v Dominique Marion, appellant. (Ind. No. 469/2015)
| DECISION & ORDER ON MOTION |
Appeal from a purported judgment of the County Court, Orange County, rendered June 26, 2018. Motion by the appellant pro se for waiver of costs, fees, and expenses and for the assignment of counsel. By order to show cause dated March 31, 2023, the parties were directed to show cause before this Court why the appeal should or should not be dismissed on the ground that no judgment of the County Court, Orange County, was rendered in the above-entitled matter on June 26, 2018, and on the ground that the notice of appeal was untimely (see CPL 460.30), counsel was assigned to respond to the order to show cause, and the appellant's motion was held in abeyance in the interim.
Now, upon the order to show cause and the papers filed in response thereto and upon the papers filed in support of the appellant's motion and the papers filed in relation thereto, it is
ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed, without costs or disbursements; and it is further,
ORDERED that the motion by the appellant is denied as academic.
CHAMBERS, J.P., WOOTEN, WARHIT and HOM, JJ., concur.
