Appeal from an order of the Supreme Court, Nassau County, dated March 13, 2024, and appeals from an order of the same court dated August 7, 2024. Motion by the appellant Tri-State Paving, LLC to extend the time to perfect its appeal from the order dated March 13, 2024. Motion by Nassau County to extend the time to perfect its appeal from the order dated March 13, 2024. Separate motion by the appellant Nassau County to extend the time to perfect its appeal from the order dated August 7, 2024.
Upon the papers filed in support of the motions and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion by the appellant Tri-State Paving, LLC to extend the time to perfect its appeal from the order dated March 13, 2024, is granted, and on or before August 25, 2025, the appellant Tri-State Paving, LLC shall serve and file the record or appendix and its brief via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the record or appendix and its brief and upload digital copies of the record or appendix and the its brief, with proof of service thereof, through the digital portal on this Court's website; and it is further,
ORDERED that the motion by Nassau County to extend the time to perfect its appeal from the order dated March 13, 2024, is denied as no appeal was taken by Nassau County from the order dated March 13, 2024; and it is further,
ORDERED that the motion by the appellant Nassau County to extend the time to perfect its appeal from the order dated August 7, 2024, is granted, and on or before August 25, 2025, the appellant Nassau County shall serve and file its brief via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve its brief and upload digital copies of the joint record or appendix and the its brief, with proof of service thereof, through the digital portal on this Court's website.
