Appeal from an order of the Supreme Court, Kings County, dated November 1, 2022. By decision and order on motion of this Court dated May 19, 2025, the appellant was directed to serve and file, via NYSCEF, a replacement brief that does not refer to matter dehors the record. The appellant has failed to file the replacement appellant's brief.
Now, on the Court's own motion, it is
ORDERED that the parties to the appeal are directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal for failure to comply with the decision and order on motion of this Court dated May 19, 2025, by serving and filing an affirmation or affidavit on that issue, via NYSCEF, on or before August 27, 2025; if the appellant be so advised, the appellant may make a motion, via NYSCEF, on or before August 27, 2025, for any relief deemed appropriate; and it is further,
ORDERED that the Clerk of the Court, or his designee, shall serve a copy of this order to show cause upon the parties to the appeal by uploading a copy of this order to show cause to the NYSCEF system.
