| ECISION & ORDER ON APPLICATION |
Application by Bruce Brown pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this Court from an order of the Supreme Court, Nassau County, dated May 2, 2025 which has been referred to me for determination.
Upon the papers filed in support of the application and the papers filed in opposition thereto, it is
ORDERED that the branch of the application which is for leave to appeal from so much of the order as denied that branch of the motion by Bruce Brown which was pursuant to CPL 440.30(1-a) is denied as unnecessary as that portion of the order is appealable as of right (see CPL 450.10[5]), and papers filed in support of this application are deemed to be a timely notice of appeal from that portion of the order; and it is further,
ORDERED that the application is otherwise denied.
