petitioner, v Noureldin M. Mohamed

Ahmed Aly Fayek, respondent.

(Docket No. F-1775-2021)

DECISION & ORDER ON MOTION

Purported appeal by Noureldin M. Mohamed Ahmed Aly Fayek from an order of the Family Court, Richmond County, dated February 26, 2024. By order to show cause dated January 22, 2025, the parties were directed to show cause before this Court why an order should or should not be made and entered recalling and vacating the decision and order of this Court dated June 21, 2024, and dismissing the purported appeal on the ground that no appeal lies from an order of a support magistrate before objections have been reviewed by a judge of the Family Court and/or dismissing the purported appeal on the ground that no notice of appeal from the order was filed by the respondent.

Now, upon the order to show cause and the papers filed in response thereto, it is

ORDERED that the motion is granted and the purported appeal is dismissed , without costs or disbursements, on the ground that no notice of appeal from the order was filed by the respondent (see CPLR 5514[a], 5515[1], Family Ct Act § 1115).
