DECISION & ORDER ON MOTION

Appeal from an order of the Family Court, Suffolk County, dated March 7, 2005, which was dismissed by decision and order on motion of this Court dated June 29, 2005, for failure to comply with a scheduling order dated April 19, 2005, issued pursuant to former § 670.3(4)(2) of the rules of this Court (see 22 NYCRR 670.3[b][2] [former 670.4(a)(2)]). Motion by the appellant, inter alia, in effect, to vacate the dismissal of the appeal, to extend the time to perfect the appeal, and for waiver of costs, fees, and expenses.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to vacate the dismissal of the appeal is denied; and it is further,

ORDERED that the motion is otherwise denied as academic.
