DECISION & ORDER ON MOTION

Appeal from a judgment of the County Court, Suffolk County, rendered July 11, 2018. Motion by the appellant pro se, in effect, to recall and vacate a prior decision and order on motion of this Court dated May 23, 2025, which recalled and vacated a prior decision and order on motion of this Court dated September 29, 2021, and for leave to serve and file a supplemental brief.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to recall and vacate a prior decision and order on motion of this Court dated May 23, 2025, which recalled and vacated a prior decision and order on motion of this Court dated September 29, 2021, is granted, and the decision and order on motion of this Court dated May 23, 2025, is recalled and vacated; and it is further,

ORDERED that the branch of the motion leave to which is for serve and file a supplemental brief is granted to the extent that the supplemental brief filed by the appellant with the Clerk's office of this Court is accepted for filing and deemed timely served, and that branch of the motion is otherwise denied.
