In the Matter of Yvette Bhikarie, appellant,

v City of New York Department of Sanitation,

respondent.

(Index No. 63/2025)

DECISION & ORDER ON MOTION

Appeal from a purported order of the Supreme Court, Kings County, dated April 30, 2025. Motion by the appellant pro se, inter alia, to stay all proceedings in the above-entitled proceeding, for waiver of costs, fees, and expenses, for the assignment of counsel, and, in effect, for leave to appeal to this Court from the order. By order to show cause dated June 4, 2025, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that no order of the Supreme Court, Kings County, dated April 30, 2025, was issued in the above-entitled proceeding. Application by the appellant to deem the notice of appeal to reflect that the appeal is from an order of the Supreme Court, Kings County, dated April 25, 2025.

Now, upon the order to show cause and the papers filed in response thereto, upon the papers filed in support of the motion by the appellant and the papers filed in opposition thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion to dismiss the appeal is denied; and it is further,

ORDERED that the application is granted and the notice of appeal is deemed to reflect that the appeal is from an order of the Supreme Court, Kings County, dated April 25, 2025; and it is further,

ORDERED that the branch of the motion by the appellant which is, in effect, for leave to appeal to this Court from the order is denied as unnecessary as the order dated April 25, 2025, is appealable as of right; and it is further,

ORDERED that the motion is otherwise denied.
