| DECISION & ORDER ON MOTION |
Appeals from an order of the Supreme Court, Queens County, dated April 10, 2024, and a judgment of the same court dated April 18, 2024. Motion by Leavitt, Kerson & Sehati, inter alia, for leave to withdraw as counsel for the appellant and to stay all proceedings in the above entitled-action, including the sale of the subject property, pending hearing and determination of the appeals.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to withdraw as counsel for the appellant is granted and on or before August 27, 2025, Leavitt, Kerson & Sehati, shall serve its client by one of the methods specified in CPLR 2103(c), with a copy of this decision and order on motion and shall file proof of such service with the Clerk of this Court, via NYSCEF, if applicable, or, if NYSCEF is not mandated, via email at [email protected]; and it is further,
ORDERED that no further proceedings shall be taken against the appellant, without leave of the Court, until the expiration of 30 days after service upon them of a copy of this decision and order on motion; and it is further,
ORDERED that on or before September 26, 2025, the appellant shall advise this Court, in writing, of the name and address of new counsel, or the appeals will be dismissed without further notice; and it is further,
ORDERED that the motion is otherwise denied.
