| DECISION & ORDER ON MOTION |
Appeal from an order of the Family Court, Queens County, dated July 1, 2024, which was deemed dismissed by decision and order on motion of this Court dated June 13, 2025, for failure to comply with a scheduling order dated February 19, 2025 , issued pursuant to § 670.3(b)(2) of the rules of this Court (22 NYCRR 670.3[b][2]). Motion by the appellant to vacate the dismissal of the appeal, for waiver of costs, fees, and expenses, for the assignment of counsel, and to extend the time to perfect the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to vacate the dismissal of the appeal is denied; and it is further,
ORDERED that the motion is otherwise denied as academic.
