Appeal from a decision and order (one paper) of the Supreme Court, Kings County, dated October 10, 2024. Motion by the appellant to extend the time to perfect the appeal.
Now, upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that on the Court's own motion, the appeal is dismissed, without costs or disbursements, on the ground that the right of direct appeal from the decision and order terminated upon entry in the above-entitled action of a judgment of the same court dated April 28, 2025 (see Matter of Aho, 39 NY2d 241); and it is further,
ORDERED that the motion by the appellant is denied as academic; and it is further,
ORDERED that the Court's own motion to dismiss the appeal, which was previously held in abeyance by decision and order on motion of this Court dated March 7, 2025, is denied as academic.
