Appeal from a judgment of the Supreme Court, Nassau County, rendered June 20, 2024. Motion by the defendant to amend a decision and order on motion of this Court dated June 28, 2024, which granted the appellant's motion pursuant to CPL 460.50 for a stay of execution of the judgment, and directed that the appellant be released from incarceration upon certain conditions.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted to the extent that the decision and order on motion dated June 28, 2024, is amended by deleting from the first decretal paragraph thereof the words "remain confined to his residence, except for visits to his place of worship, his attorney, his doctors, or court, and must travel directly from his residence to his place of worship, his attorney, his doctors, or court, and directly back to his residence, when conducting those visits" and substituting therefor the words "remain within and shall not travel beyond the geographical limits of Nassau County and Suffolk County within the State of New York," and the motion is otherwise denied.
