ORDER TO SHOW CAUSE

Appeal and cross-appeal from an order of the Family Court, Nassau County, dated August 18, 2023. The appellant-respondent perfected the appeal on June 25, 2024, the respondent-appellant filed a brief on September 13, 2024, the attorney for the child filed a brief on October 24, 2024, the appellant-respondent filed a reply brief on January 2, 2025, and the respondent-appellant filed a reply brief on February 3, 2025. The matter was placed on the calendar for September 4, 2025. On September 3, 2025, the appellant-respondent and the respondent-appellant submitted a stipulation withdrawing the appeal and cross-appeal on the ground that the matter had settled.

Now, on the Court's own motion, it is

ORDERED that the appellant-respondent, the respondent-appellant, James A. DeFelice, the appellant-respondent's counsel, and Quatela Chimeri PLLC, the respondent-appellant's counsel, are directed to show cause before this Court why an order should or should not be made and entered imposing such sanctions and/or costs, if any, against them pursuant to 22 NYCRR 1250.2(c) as this Court may deem appropriate, by filing an affirmation or an affidavit on that issue in the office of the Clerk of this Court on or before October 8, 2025, by ordinary mail; counsel may respond to this order to show cause, if so advised, by uploading a digital copy of an affirmation or an affidavit through the digital portal on this Court's website, with proof of service thereof, on or before October 8, 2025; and it is further,

ORDERED that the Clerk of this Court, or his designee, is directed to serve a copy of this order to show cause upon the parties or their attorneys, via email to the email address provided to this Court, or if no email address is available for service by regular mail.
