Appeals from an two orders of the Supreme Court, Orange County, dated December 6, 2022, and December 1, 2023, respectively, and appeal from a judgment of the same court dated December 13, 2022. The appeal from the order dated December 1, 2023 was deemed dismissed pursuant to 22 NYCRR 1250.10(a). Motion by the appellant to extend the time to perfect the appeal from the order dated December 6, 2022, and the judgment.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that on the Court's own motion, the parties are directed to show cause why the appeal should or should not be dismissed on the ground that the appellant is not aggrieved by the order dated December 6, 2022 and the judgment (see CPLR 5511), and/or that the order and the judgment have been superseded the order dated December 1, 2023, and/or that the order and the judgment have been rendered academic, by serving and filing, via NYSCEF, a digital copy of an affirmation or an affidavit on that issue on or before October 17, 2025; and it is further,

ORDERED that the motion by the appellant is held in abeyance in the interim; and it is further,

ORDERED that the Clerk of this Court, or his designee, is directed to serve a copy of this order to show cause upon counsel by uploading a copy of this order to show cause to the NYSCEF system.
