Plaintiff having moved to strike the record and brief filed by defendant on the appeal taken herein from an order of the Supreme Court, Erie County, entered April 12, 2024, and for other relief,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted and the record and brief filed by defendant is hereby stricken, and
It is further ORDERED that the appeal is removed from the term of this Court commencing on December 1, 2025, and
It is further ORDERED that on or before October 30, 2025, defendant shall file a new brief and record on appeal that fully comports with Supreme Court's order settling the record dated August 20, 2025, and in the event of the failure to do so, the appeal is hereby dismissed without further order.
