DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Marcus Alexander, Appellant.

Application by Lisa A. Packard, Esq. on behalf of the appellant to waive costs, fees, and expenses and for the assignment of counsel pursuant to Criminal Procedure Law § 380.55 (2) on an appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered February 25, 2025.

Upon the papers filed in support of the application and no papers having been filed in opposition thereto, it is

ORDERED that on the court's own motion, the parties are directed to show cause why the appeal should or should not be dismissed on the ground that the appellant is not aggrieved by the judgment of conviction, by filing an affirmation or affidavit on that issue, with proof of service thereof, on or before October 10, 2025; and it is further,

ORDERED that the application to waive costs, fees, and expenses and for assignment of counsel is held in abeyance pending determination of this court's own motion to dismiss the appeal; and it is further,

ORDERED that the Clerk of this Court or his designee is directed to serve a copy of this order to show cause upon defendant's counsel, and upon the District Attorney, by ordinary mail pursuant to CPL 470.60(2).
