Appeals from three orders of the Supreme Court, Queens County, dated May 3, 2019, October 28, 2019, and April 1, 2022, respectively, and an order and judgment (one paper) of the same court dated August 29, 2022. The appeals from the orders dated May 3, 2019, and October 28, 2019, were determined by decision and order of this Court dated October 26, 2022. Motion by the respondent for leave to reargue the appeals from the orders dated May 3, 2019, and October 28, 2019. Motion by the appellants to consolidate the appeal from the order and judgment dated August 29, 2022, with the appeal from the order dated April 1, 2022.

Upon the papers filed in support of the motion by the respondent and the papers filed in opposition thereto, and upon the papers filed in support of the motion by the appellants and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion by the respondent is denied, with $100 costs; and it is further,

ORDERED that on the Court's own motion, the parties are directed to show cause before this Court why an order should or should not be made and entered dismissing the appeals from the order dated April 1, 2022 and the order and judgment dated August 29, 2022, in the above-entitled actions on the ground that they have been rendered academic, by serving and filing, via NYSCEF, a digital copy of an affirmation or an affidavit on that issue on or before October 29, 2025; and it is further,

ORDERED that the motion by the appellants is held in abeyance in the interim; and it is further,

ORDERED that the Clerk of this Court, or his designee, is directed to serve a copy of this order to show cause upon counsel by uploading a copy of this order to show cause to the NYSCEF system.
