DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Nassau County, dated November 17, 2023. By order to show cause dated August 6, 2025, the parties were directed to show cause before this Court why the appeal should or should not be dismissed on the ground that it has been rendered academic, and/or that the appellant is not aggrieved. Motion by the respondent to strike stated portions of the reply brief on the ground that it contains matter dehors the record.

Now, upon the order to show cause and the papers filed in response thereto, and upon the papers filed in support of the motion by the respondent, and the papers filed in opposition thereto, it is

ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed without costs and disbursements (see CPLR 5511) ; and it is further,

ORDERED that the motion by the respondent is denied as academic.
