Appeal by David Simpkins from an order of the Supreme Court, Nassau County, dated November 20, 2024, issued pursuant to CPL 440.47. Motion by the defendant to consolidate the appeal from the order dated November 20, 2024, with an appeal from an order of the same court dated July 29, 2025.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied as academic as the defendant's application pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this Court from the order dated July 29, 2025, is being denied by decision and order on application decided herewith.
