It is Ordered that the motion and cross motion are consolidated for disposition.
It is further Ordered that the motion of the petitioner-respondent seeking to dismiss the pending appeal is denied as moot.
It is further Ordered that the motion of the petitioner-respondent seeking the release of the funds on deposit with the City of New York Department of Finance is granted. The Commissioner of the Department of Finance of the City of New York is directed to release the funds currently on deposit in this matter, minus any statutory fees, to the petitioner-respondent.
It is further Ordered that the respondent-appellant's cross-motion seeking consolidation with a motion, yet to be filed, seeking reargument is denied as premature.
