Appeals from an order of the Supreme Court, Suffolk County, dated May 30, 2024, a decision of the same court dated June 3, 2024, and a judgment of the same court dated August 26, 2024. The appeals from the order and the decision were deemed dismissed pursuant to 22 NYCRR 1250.10(a). Motion by the appellant pursuant to 22 NYCRR 1250.10(c) to vacate the dismissal of the appeals from the order and the decision. Motion by the respondent, in effect, to dismiss the appeals from the order and decision on the ground that the right of direct appeal from the order and the decision terminated upon entry in the above-entitled action of the judgment. Separate motion by the appellant to withdraw the appeals from the order and the decision, and for leave to file a supplemental appendix containing certain material on the appeal from the judgment.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the motion vacate the dismissal of the appeals from the order and the decision and the branch of the motion which is to withdraw the appeals from the order and the decision are granted, the dismissal of the appeals from the order and the decision pursuant to 22 NYCRR 1250.10(a) is vacated, and the appeals from the order and the decision are deemed withdrawn; and it is further,

ORDERED that the motion by the respondent is denied as academic; and it is further,

ORDERED that the branch of the motion by the appellant which is for leave to file a supplemental appendix containing certain material on the appeal from the judgment, is granted, and on or before November 17, 2025, the appellant shall serve and file a supplemental appendix on the appeal from the judgment containing the notice of appeal from the order dated May 30, 2024, and the order dated May 30, 2024, via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the supplemental appendix and upload a digital copy of the supplemental appendix, with proof of service thereof, through the digital portal on this Court's website.
