Respondent having moved to dismiss the appeals taken herein from the judgments of the Seneca County Court, rendered March 29, 2023, and May 10, 2023, on the ground that appellant has died during the pendency of the appeals,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted, and the appeals are dismissed, and
It is further ORDERED that the matters are remitted to Seneca County Court, to vacate the judgments of conviction and dismiss the indictments (see People v Matteson, 75 NY2d 745, 747 [1989]).
