DECISION & ORDER ON MOTION

1030 Park Place Property LLC, Respondent, v Robin Johnson and Sabrina Owes, Tenants, Regina Owes, Appellant, "John Doe" and "Jane Doe", Undertenants.

Motion by appellant for an extension of time to perfect an appeal from a judgment of the Civil Court of the City of New York, Kings County, entered March 28, 2024, and for an order directing respondent's counsel to turn over trial Exhibit E to appellant's counsel for inclusion in the record on appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the branch of the motion seeking an extension of time to perfect the appeal is granted and appellant shall perfect the appeal on or before December 5, 2025; and it is further,

ORDERED that in the event the appeal is not perfected by December 5, 2025, the court, on its own motion, may dismiss the appeal, or respondent may move, on three days' notice, to dismiss the appeal, and may, if appellant is unrepresented, serve such motion upon appellant in person; and it is further,

ORDERED that the branch of the motion seeking an order directing respondent's counsel to turn over trial Exhibit E to appellant's counsel for inclusion in the record on appeal is likewise granted, and respondent's counsel shall provide appellant's counsel with a true copy of such exhibit with seven (7) days of the date of this Decision and Order on Motion.
