DECISION & ORDER ON MOTION

Appeals from two orders of the Supreme Court, Nassau County, dated August 5, 2024, and November 26, 2024, respectively. Motion by the appellant, inter alia, to strike the respondent's brief, in effect, on the ground that counsel on the brief is not the attorney of record for the respondent and to extend the time to serve and file a reply brief. Cross-motion by the respondent, inter alia, to impose sanctions upon the appellant for filing a frivolous motion.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the cross-motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to strike the respondent's brief is denied; and it is further,

ORDERED that the branch of the motion which is to extend the time to serve and file a reply brief is denied as unnecessary as the reply brief has been timely served and filed; and it is further

ORDERED that the motion is otherwise denied; and it is further,

ORDERED that the cross-motion is denied.
