Appeal from an order of the Supreme Court, Queens County, dated January 26, 2017, which was deemed dismissed pursuant to 22 NYCRR 1250.10(a). Motion by the respondent, inter alia, to dismiss the appeal on the ground that the right of direct appeal from the order dated January 17, 2017, terminated upon entry in the above-entitled action of a judgment of the same court dated September 9, 2019 (see Matter of Aho, 39 NY2d 241).
