Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from an order of the Supreme Court, Niagara County, dated July 31, 2024,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the notice of appeal filed in the Niagara County Clerk's Office on August 4, 2025, which lists the date of the order being appeal from as May 1, 2024, shall be treated as valid as to the order dated July 31, 2024, pursuant to CPL 460.10 (6), and

It is further ORDERED that the motion is granted, and the notice of appeal filed on August 4, 2025, is deemed timely filed and served.
