DECISION & ORDER ON MOTION

Motion by the defendant for waiver of costs, fees, and expenses and for the assignment of counsel with respect to an application for a writ of error coram nobis seeking leave to file a late notice of appeal from a judgment of the Supreme Court, Queens County, rendered June 5, 1987.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied as academic, as the defendant's application for a writ of error coram nobis seeking leave to file a late notice of appeal from the judgment is being denied by decision and order on application decided herewith.
