Appeals from a judgment of the Supreme Court, Queens County, rendered July 12, 1988, and, by permission, from an order of the same court dated December 4, 1990, which were decided by decision and order of this Court dated April 19, 1993 (see People v Yonamine, 192 AD2d 687). Motion by the appellant for waiver of costs, fees, and expenses and for the assignment of counsel with respect to an application for a writ of error coram nobis seeking to vacate, on the ground of ineffective assistance of appellate counsel, the decision and order of this Court dated April 19, 1993.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied as academic, as the defendant's application for a writ of error coram nobis seeking to vacate, on the ground of ineffective assistance of appellate counsel, the decision and order of this Court dated April 19, 1993, is being denied by decision and order on application decided herewith.
