| DECISION & ORDER ON MOTION |
Appeal from a judgment of the Supreme Court, Kings County, rendered December 18, 2017. Motion by assigned counsel to be relieved of the assignment to prosecute the appeal, and to withdraw the appeal. By order to show cause dated August 5, 2022, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled matter on the ground that it has been rendered academic.
Now, upon the order to show cause and the papers filed in response thereto, and upon the papers filed in support of assigned counsel's motion and the papers filed in relation thereto, it is
ORDERED that assigned counsel's motion is granted, counsel is relieved of the assignment and the appeal is deemed withdrawn; and it is further,
ORDERED that the motion to dismiss the appeal is denied as academic.
