Appeal from a judgment of the Supreme Court, Richmond County, rendered October 10, 2019. Motion by the appellant's assigned counsel for leave to serve and file a supplemental brief raising an excessive sentence claim.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted, and on or before December 12, 2025, the appellant's assigned counsel shall serve and file a supplemental brief raising an excessive sentence claim, via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the supplemental brief and upload a digital copy of the supplemental brief, with proof of service thereof, through the digital portal on this Court's website; and it is further,
ORDERED that on the Court's own motion, the respondent may serve and file a brief in response to the supplemental brief filed by assigned counsel on or before January 12, 2026, via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the brief and upload a digital copy of the brief, with proof of service thereof, through the digital portal on this Court's website.
