Appeals from five orders of the Supreme Court, Suffolk County, dated October 4, 2024 (two orders), October 30, 2024, May 21, 2025, and October 3, 2025, respectively. The appeals from the orders dated October 4, 2024, and the order dated October 30, 2024, were deemed dismissed pursuant to 22 NYCRR 1250.10(a). Motion by the appellant pursuant to 22 NYCRR 1250.10(c) to vacate the dismissal of the appeals from the order dated October 4, 2024, under Appellate Division Docket No. 2024-11934, and the order dated October 30, 2024, and to extend the time to perfect those appeals. Separate motion by the appellant, inter alia, to stay enforcement of the order dated October 30, 2024, pending hearing and determination of the appeals. Separate motion by the appellant to stay enforcement of stated portions of the order dated May 21, 2025, pending hearing and determination of the appeals. Separate motion by the appellant, inter alia, to stay enforcement of the order dated October 3, 2025, pending hearing and determination of the appeals.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to vacate the dismissal of the appeal from the order dated October 4, 2024, under Appellate Division Docket No. 2024-11934 is denied; and it is further,
ORDERED that the branch of the motion which is to extend the time to perfect the appeal from the order dated October 4, 2024, under Appellate Division Docket No. 2024-11934, is denied as academic; and it is further
ORDERED that the branches of the motion which are to vacate the dismissal of the appeal from the order dated October 30, 2024, and to extend the time to perfect that appeal from the order dated October 30, 2024, are granted, the dismissal of the appeal from the order dated October 30, 2024, pursuant to 22 NYCRR 1250.10(a) is vacated, and on or before January 13, 2026, the appellant shall and serve and file the record or appendix and the appellant's brief on the appeal from the order dated October 30, 2024, via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the record or appendix and the appellant's brief and upload digital copies of the record or appendix and the appellant's brief, with proof of service thereof, through the digital portal on this Court's website; and it is further,
ORDERED that the motion, inter alia, to stay enforcement of the order dated October 30, 2024, pending hearing and determination of the appeals, is denied; and it is further,
ORDERED that the branch of the motion which is to stay enforcement of stated portions of the order dated May 21, 2025, is granted to the extent that so much of the order dated May 21, 2025, as directed the appellant's incarceration, in the event that he fails to purge his contempt by paying certain sums is stayed, pending hearing and determination of the appeals, on condition that the appeal is perfected on or before December 15, 2025; and it is further,
ORDERED that the branch of the motion which is to stay enforcement of stated portions of the order dated October 3, 2025, is granted to the extent that so much of the order dated October 3, 2025, as directed the appellant's incarceration, in the event that he fails to purge his contempt by paying certain sums is stayed, pending hearing and determination of the appeals, on condition that the appeal is perfected on or before December 15, 2025; and it is further,
ORDERED that in the event the appeals from the orders dated May 21, 2025, and October 3, 2025, are not perfected on or before December 15, 2025, the Court, on its own motion, may vacate the stay, without further notice, or the respondent may move to vacate the stay, on three days notice; and it is further,
ORDERED that the motions are otherwise denied; and it is further
