Application by the defendant pursuant to CPL 245.70(6) to vacate or modify a ruling of a Justice of the Supreme Court, Queens County, as set forth in a protective order of that Court dated October 29, 2025.
Upon the papers filed in support of the application and the papers filed in opposition thereto, it is
ORDERED that the application pursuant to CPL 245.70(6) is denied; and it is further,
ORDERED that the transcript of the proceedings, and the affirmation in support of a protective order pursuant to CPL 245.70 dated October 19, 2025, which were submitted under seal by the People in connection with this application pursuant to CPL 245.70(6), are deemed to be filed under seal, and shall continue to be sealed; and it is further,
ORDERED that the affirmation in opposition dated November 7, 2025, and annexed memorandum of law submitted by the People in connection with this application pursuant to CPL 245.70(6) shall be marked confidential to the extent that they may only be viewed by counsel appearing on behalf of the parties.
