Appeals from an order of the Supreme Court, Nassau County, dated January 21, 2025, and a judgment of the same court rendered March 25, 2025. Motion by the appellant to stay enforcement of the judgment, pending hearing and determination of the appeals, and for a preference in the calendaring of the appeals. Motion by Petroske Riezenman & Meyers, P.C., to withdraw as counsel for the appellant and to extend the time to perfect the appeals.
Upon the papers filed in support of the motion by appellant and the papers filed in opposition thereto, and upon the papers filed in support of the motion by Petroske Riezenman & Meyers, P.C. and the papers filed in relation thereto, it is
ORDERED that the motion by the appellant is denied; and it is further,
ORDERED that the branch of the motion to withdraw as counsel for the appellant
is granted and on or before November 28, 2025, Petroske Riezenman & Meyers, P.C. shall serve its client by one of the methods specified in CPLR 2103(c), with a copy of this decision and order on motion and shall file proof of such service with the Clerk of this Court, via NYSCEF, if applicable, or, if NYSCEF is not mandated, via email at [email protected]; and it is further,
ORDERED that no further proceedings shall be taken against the appellant, without leave of the Court, until the expiration of 30 days after service upon him of a copy of this decision and order on motion; and it is further,
ORDERED that the branch of the motion which is to extend the time to perfect the appeals is granted, and on or before January 28, 2026, the appellant shall serve and file the record or appendix and the appellant's brief via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the record or appendix and the appellant's brief and upload digital copies of the record or appendix and the appellant's brief, with proof of service thereof, through the digital portal on this Court's website.
