Appeal from a judgment of the Supreme Court, Queens County, rendered December 13, 2022. Motion by the appellant, in effect, for leave to serve and file a supplemental brief raising an argument concerning the applicability of the Marijuana Regulation and Taxation Act.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted, and on or before December 8, 2025, the appellant shall serve and file a supplemental brief raising an argument concerning the applicability of the Marijuana Regulation and Taxation Act, via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the supplemental brief and upload a digital copy of the supplemental brief, with proof of service thereof, through the digital portal on this Court's website.
