Appeals from an order of the Supreme Court, Kings County, dated December 20, 2021. The appeal by third-party defendants-appellants was deemed dismissed pursuant to 22 NYCRR 1250.10(a). The defendants third-party plaintiffs-appellants perfected their appeal on October 19, 2022, the plaintiffs-respondents filed their brief on December 16, 2022, the third-party defendants-appellants filed their brief on January 20, 2023, and the defendants third-party plaintiffs-appellants filed a reply brief on February 21, 2023. Counsel for the parties did not respond to a status inquiry from this Court on June 17, 2025. The matter was placed on the calendar for November 17, 2025. On November 13, 2025, Segal McCambridge Singer & Mahoney, counsel for the defendants third-party plaintiffs-appellants, submitted a letter application to withdraw as counsel, which notified this Court that the action had settled. The parties submitted a stipulation on November 14, 2025, withdrawing the appeal. Documentation submitted to this Court with the stipulation indicated that the action settled on April 4, 2025.
Now, on the Court's own motion, it is
ORDERED that Segal McCambridge, Singer & Mahoney, Ltd. and Manning Gross & Massenburg LLP, counsel for the defendants third-party plaintiffs-appellants, Morgan Levine Dolan, P.C. and Michael H. Zhu, Esq., P.C., counsel for plaintiffs-respondents, and London Fischer, LLP, counsel for the third-party defendants-appellants, are directed to show cause before this Court why an order should or should not be made and entered imposing such sanctions and/or costs, if any, against them pursuant to 22 NYCRR 1250.2(c) as this Court may deem appropriate, by serving and filing, via NYSCEF, a digital copy of an affirmation or an affidavit on that issue on or before December 22, 2025; and it is further,
ORDERED that the Clerk of this Court, or his designee, is directed to serve a copy of this order to show cause upon counsel by uploading a copy of this order to show cause to the NYSCEF system.
