DECISION & ORDER ON MOTION

Appellant moved for an extension of time to perfect an appeal from a decision of the Civil Court of the City of New York, Queens County, dated June 26, 2024. It came to the attention of the court that a stipulation of discontinuance may have been filed in the trial court.
On the court's own motion dated September 22, 2025, the parties were directed to show cause why the appeal should or should not be dismissed, on the ground that the appeal has been rendered moot by the filing of a "Stipulation of Discontinuance" with the trial court.
Upon the affirmation of appellant's counsel in opposition to the order to show cause, and upon the papers filed in support of the motion for an extension of time to perfect the appeal, it is hereby
ORDERED that the court's own motion to dismiss the appeal is denied; and it is further
ORDERED that the motion for an extension of time to perfect the appeal is granted, and the appeal shall be perfected on or before December 19, 2025; and it is further,
ORDERED that in the event the appeal is not perfected by December 19, 2025, the court, on its own motion, may dismiss the appeal, or respondent may move, on three days' notice, to dismiss the appeal, and may, if appellant is unrepresented, serve such application upon appellant in person.
