| DECISION & ORDER ON MOTION |
2025-11211
Nationstar Mortgage LLC, etc., respondent,
v Glenna Deveaux, et al., defendants,
Keno DeCosta, etc., appellant.
(Index No. 714560/2017)
Appeals from an order of the Supreme Court, Queens County, dated August 23, 2024, and a judgment of the same court dated July 17, 2025. Motion by the respondent to dismiss the appeal from the order on the ground that the right of direct appeal from the order terminated upon entry in the above-entitled action of the judgment or, in the alternative, to extend the time to serve and file a brief on the appeal from the order.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal from the order is granted and the appeal from the order is dismissed, without costs or disbursements (see Matter of Aho, 39 NY2d 241); and it is further,
ORDERED that the motion is otherwise denied as academic.
IANNACCI, J.P., CHRISTOPHER, LANDICINO and HOM, JJ., concur.
